1. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract under the Indian Contract Act, 1872, to use our services. By using the Platform you represent and warrant that you meet these requirements. We reserve the right to refuse service to anyone at our discretion.

2. Nature of the Platform

UsedCarSpare is a multi-vendor marketplace that facilitates transactions between independent sellers and buyers of used/refurbished automobile spare parts. V16 Trading Private Limited is not a party to the actual sale of any part; the contract of sale is directly between the buyer and the seller. We do not represent or warrant the quality, safety, or legality of parts listed by sellers, or the accuracy of listings.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and up-to-date information during registration.
• You must notify us immediately of any unauthorised use of your account.
• Each person may maintain only one account. Multiple accounts may be terminated.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Buyer Terms

• Always verify part compatibility (make, model, year, variant) before purchasing. Listings include compatibility information but buyers are responsible for confirming fitment.
• Prices displayed are inclusive of all applicable taxes unless stated otherwise.
• Payment must be completed at checkout. Orders are not confirmed until payment is received.
• Delivery timelines are estimates and may vary due to logistics and seller processing times.
• Returns are governed by our Shipping & Returns Policy.

5. Seller Terms

• Sellers must complete the KYC/verification process before listing parts.
• All listings must accurately describe the part's condition, compatibility, and any defects.
• Sellers are prohibited from listing stolen parts, counterfeit goods, or parts under recall for safety reasons.
• Sellers must fulfil orders within the committed processing time. Repeated failures may result in account suspension.
• Platform fees and commission rates are as published in the Seller Dashboard and may be updated with 30 days' notice.
• Sellers are solely responsible for all applicable taxes (GST, income tax) on their sales.

6. Prohibited Activities

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• List or sell stolen, cloned, or tampered vehicle parts.
• Engage in price manipulation, shill bidding, or fraudulent reviews.
• Scrape, crawl, or use automated tools to access the Platform without permission.
• Circumvent our payment system by transacting off-Platform.
• Upload malicious code, viruses, or any material that disrupts the Platform.
• Harass, threaten, or discriminate against other users.

7. Intellectual Property

All content on the Platform including logos, software, design, text, graphics, and the "UsedCarSpare" brand is the intellectual property of V16 Trading Private Limited or its licensors. You may not copy, reproduce, modify, or distribute any content without our prior written consent. User-generated content (reviews, photos) remains owned by the user, but you grant us a non-exclusive, royalty-free licence to use it on the Platform for promotional purposes.

8. Limitation of Liability

To the maximum extent permitted by law, V16 Trading Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to vehicle damage caused by incorrect parts, loss of profits, or data loss. Our total aggregate liability for any claim shall not exceed the amount paid by you for the specific transaction giving rise to the claim.

9. Dispute Resolution

For disputes between buyers and sellers, we provide a mediation service through the Platform. Disputes unresolved through mediation shall be subject to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in Coimbatore, Tamil Nadu, with proceedings in English. These Terms are governed by the laws of India.

10. Modifications to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or an in-app notification at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
